Street Racing Car Crash resulted in death of the driver

According to Fox 4 News (mydfwfox.com), driver of a BMW who was racing, lost the control of his car and died after hitting 4 other vehicles. The car accident happened around 9 pm on Northwest Highway near Shady Brook Lane. The driver of the BMW was racing another vehicle, and lost the control of his car and hit four other vehicles. One of these vehicles hit a fifth vehicle.

According to the information so far, at least one other person was seriously hit. The car that was racing with BMW allegedly took off. Dallas police is investigating the auto accident.

Work related case got settlement

A pending lawsuit in Etowah County, Alabama was recently settled. The case was regarding a motor vehicle accident in which Terry Franklin was involved. The accident occurred while Mr. Franklin was driving a commercial vehicle after picking up a load of chickens. On his way back to the plant, an intoxicated driver struck Mr. Franklin while making a left turn in front of his vehicle.

Mr. Franklin’s employer had not provided insurance for the vehicle that he was driving so a suit was filed against the company Koch’s poultry as well as a suit against a local bar where the drunk driver had previously been drinking. Along with this, Mr. Franklin sued his employer for workers compensation benefits. Mr. Franklin, endured injury in his shoulder and neck as well as a concussion and extreme glaucoma to his right eye. As a result of this, he had to have an interior cervical fusion surgery and received continuous pain management for his neck pain. Mr. Franklin was also unable to return to work in the only two fields that he has worked in: being a truck driver or being a diesel mechanic.

On top of the monetary compensation received, the settlement kept medicals open and contained a waiver of the worker’ compensation claim.

Medical Malpractice Lawsuits Are Rarely Successful – New England Journal of Medicine Study

CBSNEWS (www.cbsnews.com) – Medical malpractice affects 1 in 14 doctors each year, although only about 1 in 5 of those claims lead to an actual damage payout, according to a new study that has been fully evaluated by the New England Journal of Medicine.  The study included 41,000 doctors and found that almost every doctor will face a minimum of one medical malpractice claim and the stats are even higher for surgeons. 

The study showed that most medical malpractice lawsuits that are filed have no actual basis. Another study conducted in New York found that a small portion of patients who could have a potential malpractice case actually file the case or see it through.  Those patients who have been harmed by medical mistakes rarely file because of the fees that come along with a lawsuit. 

On the other hand, doctors, hospitals, along with their insurers have highly proficient financial and legal power.  Many states have a limit to how much an individual can actually receive from a malpractice case.  Researchers claim that it is doubtful that malpractice claims are filed in a greedy manner due to the fact that there is usually a lump sum due before the case even begins.

The study found that claims are filed against 7.5 percent of doctors each year, less than 2 percent of doctors actually had to pay out a settlement for a claim that was successful, and in the case that a pediatrician was found guilty of negligence, they had to pay out much higher for damages than other doctors.  Many individuals claim that there should be stricter guidelines for doctors, hospitals, and individuals who are actually filing a medical malpractice lawsuit

Maryland Resident Receives $11.8 Million Verdict in Drunk Driving Case

Michael W. Harris has been awarded $11.8 million by a Maryland jury due to his complications after being rear-ended by a repeat drunk driving offender.  Mr. Harris developed a painful and devastating nerve condition after being struck by the drunk driver, which has caused him to spend most of his life in a wheelchair.


The drunk driver struck Mr. Harris in 2007, as he sat at an intersection waiting for the traffic light.  The driver then fled the scene but was soon found by police officials who administered two sobriety tests, which the driver failed.  The drunk driver was charged with a DUI and has a record of previous DUI’s.

Company involved in San Marcos Bus Accident has been issued Safety Violations in the past

It has recently been found that a charter bus company involved in an accident on last Friday, had been dealing with several technical problems over the past two years. The bus accident that sent at least 18 people to the hospital happened on Interstate 35 near San Marcos, TX. The recent accident was caused by the bus driver who allegedly was driving the bus off of the road, turned the bus at the last minute, causing the bus to overturn.

According to the Federal Motor Carrier Safety Administration, many technical problems were found that should have shut the bus carrier business down.  Mares Bus Line Inc. is located and operated in Dallas Texas by Alberto and Noel Mares.  The company has been issued several violations after undergoing 55 inspections from the Federal Motor Carrier Safety Administration.  Over the past couple years the bus company has had five violations of unsafe driving, three violations of speeding, two violations of driver fatigue, 81 violations of vehicle maintenance, and two violations of illegal driving due to no commercial driver’s license of one or more bus drivers.

The company has a previous bus accident on their record that injured three individuals.  All of the individuals on the bus of the recent accident had to be taken to the hospital.  Mares Bus Line Inc. was given a rating of satisfactory by the Motor Carrier Safety Administration.

Possibility of Harsher Charges for those Found with Drugs in System

According to KVUE News, Austin the National Highway Traffic Safety Administration released a report that found that one in five drivers that were killed in automobile accidents last year tested positive for drugs.   The report did not indicate whether or not the drugs actually caused the accidents or if they even played a roll in impairing the driver at all.

The major safety concern has prompted Texas, as well as many other states, to attempt to build a case for blood draws, since they disclose the actual amount of drugs in a person’s system.  Jason Dusterhoft, commander of the Austin Police Department claims that the new system would “actually break it down to what kind of drugs a person was using and what level that person had in their system”.  Information drawn from an individual’s blood could possibly lead to tougher charges and maybe even eventually tougher laws.

Motorcyclists Struck By Truck On Two-Way Street

Four motorcycle riders and one passenger were killed in San Diego, when a driver slammed into the motorcycle group on the road. The man has been arrested on suspicion of driving under the influence, but police are still looking into this as another driver may have triggered the crash.

The motorcyclists were riding to celebrate their 10th anniversary of the club. The accident occurred when a driver in a Honda Civic passed them on a two-lane highway, forcing an oncoming truck off of the road, which then veered back onto the lane of the motorcyclists. Authorities are still trying to locate the Honda and its driver.

Carlos Ramirez Bobadilla, 36, swerved his Dodge Avengar to the right shoulder of the highway in order to avoid the Honda, but then soon after overcompensated by swinging to close to the left, swerving into the lane of the cyclists. Ramirez was arrested at the scene because officers claimed he smelled of alcohol. California Highway Patrol officer Deann Goudie claims that they are unsure if Bobadilla’s alleged alcohol consumption contributed to the collision.

Bobadilla was charged with a misdemeanor so far and is not being held reliable for the deaths until further evidence is identified. Authorities are taking into consideration that Bobadilla’s speedometer was found stuck at 60 mph, which was under the given speed limit. Goudie’s thoughts and prayers go out to the riders as she claims, “They were just going on a nice, leisurely ride in the desert”.

Drinking While Driving Kills Young Mother

A 23-year-old mother was killed last Tuesday in a severe car crash that involved alcohol. Her 2-year-old son, who was in the car when the accident occurred, was injured. According to the filed police report, the crash took place last Tuesday night when Tiffany Travis swerved off of the road and crashed head-on into a concrete base of a traffic light.

Travis died shortly after being taken to Baylor University Medical Center. Police state that Travis had been drinking as well as had previously been in a conflict involving her husband. Travis’ child was taken to Children’s Medical Center to receive medical care for his cuts and abrasions from the accident. Police claim the child is seeking medical attention and is expected to be released soon.

81 Year-Old Woman Survives Truck Who Ran Her Over In Bed

81 year-old Felicita Fisher is now recovering from being run over in her own bed when an alleged drunk driver crashed into her house earlier this month.  Fishner claims she was sleeping when she thought she heard a plane crash, but she of course thought otherwise after learning a pick up truck had crashed into her house. 

Police authorities arrested Gabino Lopez (54) for intoxicated assault with a vehicle, causing serious bodily injury to the woman.  Fisher explains she has suffered from a broken leg and hip from the incident and has undergone surgery.  What makes this story amazing is the fact that an abnormal sleeping pattern may have saved the woman’s life.

At the time of the crash, Fishner was not sleeping with her feet at the foot of the bed, instead, her head at the foot of the bed.  Fishner claims she did this because she claimed she had a premonition that something bad was going to happen even before she went to sleep. 

Fishner will now spend the next 60 days in rehab to fully heal.  Gabino Lopez is now out on $20,000 bond and is expected to attend court for his first hearing.

Halloween Lanterns recalled for overheating sold at Dollar Tree Stores

CNN has reported that the Consumer Product Safety Commission and Dollar Tree Stores announced Thursday that they are recalling 682,000 battery-operated Halloween lanterns saying they can overheat. “This recall involves plastic Halloween-Themed Lanterns designed to resemble a pumpkin, ghost and skull,” a statement from the CPSC says.

The bulb in the battery-operated lanterns can overheat, posing fire and burn hazards to consumers.  Dollar Tree claims there has been only one report of a Halloween Lantern overheating, no injuries have been reported to date. The Dollar Tree Halloween Lanterns were distributed to stores nationwide.

The model number 954439-13096-003-1005 is printed on a label on the bottom of the lanterns. Consumers should take the recalled lanterns away from children immediately, remove and properly discard the batteries and return the lanterns to the store where purchased for a full refund.
