Pfizer Receives Warning Letter from FDA

Pfizer received a warning letter last month from the FDA because of the company’s failure to report complaints promptly. The agency warned Pfizer about its failure to promptly report complaints associated with its drugs that may have involved serious injuries. Pfizer repeatedly failed to submit product complaints to the FDA within the required 15-day regulatory scheme. In some cases, Pfizer failed to include reports of serious side effects with the cholesterol drug Lipitor and the anti-seizure drug Lyrica.

Gas Explosion Lawsuit Filed against Dominion East Ohio Gas

A lawsuit has been filed against Dominion East Ohio Gas Co. and an investment company for a home explosion that occurred in Cleveland’s West Side.  The home explosion damaged 57 buildings and EZ Access avoided its responsibility for maintaining a vacant two-story home on West 83rd street. It’s alleged that Dominion failed to make sure gas to the house was shut off when the residents complained of the odor of gas four days before the blast. Fortunately, no one was killed or injured by the explosion.

Five Workers Killed In Connecticut Energy Plant Explosion

An explosion at an energy plant in Central Connecticut that was under construction has killed five workers and injured 12 others. Reports stated the blast could be felt miles away. The powerful explosion blew apart large swaths of the nearly completed 620-meagwatt Kleen Energy plant.  Workers for the construction company, O&G Industries Inc., were purging a gas line when the explosion took place.  Authorities said that everyone who was assigned to work at the plant at the time of the explosion was accounted for. The Board’s investigators will determine which federal safety standards apply to the Kleen Energy plant. The fuel gas code has an exemption for power plants.

Caterpillar Must Pay $54 Million to Paralyzed Texas Worker

A Texas jury returned a $54.2 million verdict against Caterpillar Inc., the world’s largest maker of bulldozers, in a lawsuit filed by an injured worker. The Plaintiff, Alfonso Lopez, contended that electronic-control defects caused the machines to unexpectedly bounce. The scraper’s bucking caused its seat to fail. The Plaintiff was slammed against the scrapper’s frame. He suffered spinal injuries and a punctured lung in the accident and is now paralyzed from the waist down. Caterpillar was ordered by the jury to pay $15.8 million in compensatory damages and $40.5 million punitive damages. Caterpillar says it will appeal the verdict.

Couple Attempts to Sell Their Baby at Wal-Mart for $25

A couple, tried to sell their baby outside a Wal-Mart on Tuesday. The incident happened on Tuesday around 7:20 PM. PDT outside a Wal-Mart in Salinas, California, when a Patrick Alan Fousek, 38, approached two women and asked if they’d like to buy his child for $25. Samantha Tomasini, 20, was reportedly in a car nearby. One women refused Fousek, and then called 911. The couple had left before police arrived, however police eventually found the couple in their home, with baby all right, but her parents high on meth. The defendants are charged with felony child endangerment, which carries a four-year maximum sentence, and misdemeanor charges of being under the influence of a controlled substance and possession of a meth pipe. The couple was arraigned on Friday at the Monterey County Jail.

It was reported, Fousek was attacked by fellow inmates Thursday night after details of the incident were shown on TV. Fousek was transported to Natividad Medical Center, where he was treated for his injuries, including two cracked ribs, before being returned to jail.

$25.16 Million Verdict Against Drug Maker In Accutane Case

Andrew McCarrell won a $25.16 million verdict against Roche Holding AG, a Swiss drug maker, after proving that the company’s acne medicine led to inflammatory bowel disease. This was the second trial of the man’s case. He testified he got sick after taking Accutane in 1995. He has had five surgeries, including one to remove his colon. In addition to this verdict, six former Accutane users have won verdicts worth $56 million. Roche stopped selling Accutane last year. Currently, Roche faces almost 1,000 other cases.

Methadone Clinic Pays $1.8m to the Family of 8-year old Jacksonville Girl

A Massachusetts for- profit methadone clinic has agreed to pay the family of an eight-year-old Jacksonville girl close to $1.8 million after she died in a head on crash involving a patient form the clinic. Stephen Fairchild, 24, had been treated at the Community Health Care Inc. earlier in the day and his autopsy results showed that the level of methadone was “peaking” at the time of the head-on accident, which killed both Fairchild and Kayla Lackey. The Lackey estate sued Community Health Care Inc. and Dr. Walter Slowinski because of their care of Fairchild, who had a long history of heroin abuse and erratic driving.

The family of a child in New York, who was killed in an MRI chamber, has settled its lawsuit for $2.9 million. Michael Colombini, who was six years old, was killed at the Westchester Medical Center when an oxygen tank flew into the chamber, drawn in by the MRI’s 10-ton chamber electromagnet. A staffer inadvertently carried the tank into the MRI room. That mistake resulted in the tragic death of the child. The family now feels they have received some justice even though it took nine years to get there. The New York State Health Department fined the hospital $22,000 over the incident.

Toy Dart Guns sold at Family Dollar Stores Recalled After Two Deaths

A nine-year-old boy in Chicago, Illinois and ten-year-old in Milwaukee, Wisconsin died after they chewed on the one-inch, soft plastic darts, which slipped into their throats. The small suction cup part of the dart cut off breathing. The consumer Product Safety Commission has announced the recall of 1.8-million toy dart gun set. The dart gun sets were sold nationwide at Family Dollar stores. Family Dollar has not sold the recalled toy dart gun in more than a year. The dart gun sets were imported by Henry Gordy International in New Jersey. Henry Gordy refused to recall the dart set so Family Dollar Stores worked with the CPSC on recalling the product.

Truck Driver Crashes While On His Cell Phone

According to the investigating officers, the Alabama truck driver was talking on a cell phone at the time of the crash in central Kentucky. The officers said the truck driver crossed the median of the interstate highway and crashed into a van carrying passengers who were traveling to a wedding. The Kentucky State Police report says the truck driver did not have his tractor-trailer under control and may have also been speeding. Another truck driver who witnessed the wreck estimated the truck driver who caused the wreck was traveling at 80 mph. This tragic incident should be a wake-up call for all employers who entrust vehicles to their employees.
