A pending lawsuit in Etowah County, Alabama was recently settled. The case was regarding a motor vehicle accident in which Terry Franklin was involved. The accident occurred while Mr. Franklin was driving a commercial vehicle after picking up a load of chickens. On his way back to the plant, an intoxicated driver struck Mr. Franklin while making a left turn in front of his vehicle.

Mr. Franklin’s employer had not provided insurance for the vehicle that he was driving so a suit was filed against the company Koch’s poultry as well as a suit against a local bar where the drunk driver had previously been drinking. Along with this, Mr. Franklin sued his employer for workers compensation benefits. Mr. Franklin, endured injury in his shoulder and neck as well as a concussion and extreme glaucoma to his right eye. As a result of this, he had to have an interior cervical fusion surgery and received continuous pain management for his neck pain. Mr. Franklin was also unable to return to work in the only two fields that he has worked in: being a truck driver or being a diesel mechanic.

On top of the monetary compensation received, the settlement kept medicals open and contained a waiver of the worker’ compensation claim.

She was then arrested and taken into the county jail. Walton’s attorney Dee J. According to Forbes Ms. Walton is the daughter of Sam Walton, who founded Wal-Mart stores. She is said to be worth an estimated 21 billion and is among the top 10 richest individuals in America.

A $2 million lawsuit has been filed against CVS Drugstores in which they have agreed to comply with the suit’s terms and conditions. The case alleges that the company falsely advertised and overcharged customers for sale items. The complaint claims that the CVS located in Rhode Island regularly charged customers more money for items that were actually on sale.

It was found that the store had been up charging since 2006. The suit also alleges that the drugstore’s advertising was misleading when they did not follow through on the advertised discounts. The judgment outlines that CVS Pharmacy Inc., will pay $1.2 million in civil penalties and $820,000 in investigative costs, to the California Dept. of Measurement Standards, and to the Consumer Protection Trust. In order to further ensure that an ordeal as such does not transpire once again, CVS has created a three-year pricing program in order to make certain that customers are never up charged again.

They are also mandating weekly in-store price inspections to make sure the prices listed are correct for consumers. CVS has agreed to pay the settlement, although the drugstore has not admitted to liability and were able to come to an agreement with prosecutors.

CBSNEWS (www.cbsnews.com) – Medical malpractice affects 1 in 14 doctors each year, although only about 1 in 5 of those claims lead to an actual damage payout, according to a new study that has been fully evaluated by the New England Journal of Medicine. The study included 41,000 doctors and found that almost every doctor will face a minimum of one medical malpractice claim and the stats are even higher for surgeons.

The study showed that most medical malpractice lawsuits that are filed have no actual basis. Another study conducted in New York found that a small portion of patients who could have a potential malpractice case actually file the case or see it through. Those patients who have been harmed by medical mistakes rarely file because of the fees that come along with a lawsuit.

On the other hand, doctors, hospitals, along with their insurers have highly proficient financial and legal power. Many states have a limit to how much an individual can actually receive from a malpractice case. Researchers claim that it is doubtful that malpractice claims are filed in a greedy manner due to the fact that there is usually a lump sum due before the case even begins.

The study found that claims are filed against 7.5 percent of doctors each year, less than 2 percent of doctors actually had to pay out a settlement for a claim that was successful, and in the case that a pediatrician was found guilty of negligence, they had to pay out much higher for damages than other doctors. Many individuals claim that there should be stricter guidelines for doctors, hospitals, and individuals who are actually filing a medical malpractice lawsuit.

The Arlington City Council is making arrangements to vote on a measure that would ban drivers from sending texts while driving. The order would only allow calls to be placed while driving, which would exclude all text messaging, emailing, and tweeting. In the case that an individual was found to be violating the new order (if passed), they would then face a $200 fine.

The City Council is expected to pass the proposed ordinance. Arlington’s City Counsel is considering replicating their model after El Paso’s ordinance, which bans all cell phone use without a hands-free device. It is proposed that the roads and highways will be safer for all drivers if the ordinance is passed.

Results as such do have a large effect in rules and regulations that are put in place across America. These results could be looked at and considered largely, especially at this time when Congress is in the process of considering the Safe Teen and Novice Driver Uniform Protection (STANDUP) proposition. The STANDUP proposition is part of the Motor Vehicle and Highway Safety Improvement Act of 2011, which was created because of the tragic death of an Arkansas teen who was killed by another driver who was texting and driving.

The STANDUP proposition would ensure safety standards that would restrict teen nighttime driving, limit the number of passengers in one car, prohibit cell phone use when driving, and permit a license issuance along with a special age requirement in a gradual process. Among the adults who were involved in the survey, most of them supported standards that would be present in the STANDUP proposition. Stricter regulations concerning America’s highways and roads would benefit America as a whole and would create safer highways and roads for every individual.

Ford Motor Company has released a report stating that they will be recalling 1.1 million pick up trucks due to a safety hazard issue involving the gas tank. It has been found that there is a possibility that the gas tank could fall off and/or cause fires. The vehicle’s defect has already caused eight fires, which injured one individual who underwent surgery for first and second-degree burns.

The National Highway Traffic Safety Administration claims that the metal straps holding the gas tanks in place can possibly rust, which could then cause the tanks to fall, rupture, and catch on fire. The recall includes certain pick up trucks that were manufactured from 1997 through 2004. The models of pickups that are being recalled include the Ford F-150, Ford F-250, and the Lincoln Blackwood Pickups.

Ford spokesman Wes Sherwood, claims that the company will notify each truck owner to bring in their vehicle so that they can replace the hazardous straps with new ones that are coated to resist corrosion.
